End User License Agreement

1. Acceptance of Terms

By downloading, installing, or using the Cookies NM Loyalty App ("the App"), you agree to abide by this End User License Agreement ("EULA") in its entirety. If you do not accept all terms, you are prohibited from using the App, and you must delete it from your device.


2. License Grant

The Cookies NM Loyalty App and its affiliates ("Company") grant you a limited, non-exclusive, non-transferable, and revocable license to use the App for personal, non-commercial purposes. This license is subject to your full compliance with this EULA and any applicable Company Terms of Use and Privacy Policy.


3. Use of the Loyalty Program

Through the App, users may track loyalty points earned through purchases, view redeemable rewards, and place online orders. Points hold no cash value, are non-transferable, and may expire in accordance with the loyalty program rules detailed within the App. Points and rewards may be modified or terminated at the Company’s discretion.


4. User Conduct and Restrictions

You agree not to: 

Use the App for any unlawful or prohibited activities.


Circumvent any security measures implemented within the App.


Access, collect, or share information about other users without authorization.


Attempt to reverse-engineer, alter, or create derivative works from the App’s code or functionality.


Share your account or login credentials with others.


5. Privacy and Data Collection

By using the App, you consent to the Company’s collection, use, and disclosure of personal information as detailed in the Cookies NM Privacy Policy. The App may collect and store data necessary to provide loyalty services, improve the App, and enhance user experience. Please review our Privacy Policy for more information on how we handle personal data.




6. Third-Party Links and Services

The App may contain links to external sites or services. The Company does not control, endorse, or assume responsibility for third-party sites or their content. Access to third-party sites is at your own risk and subject to their own terms and policies.


7. Intellectual Property Rights

All intellectual property rights associated with the App, including text, graphics, logos, trademarks, and software code, are the property of the Company or its licensors. You agree not to copy, modify, distribute, or reverse-engineer any part of the App.


8. Modification and Termination

The Company reserves the right to modify or discontinue any features of the App, including loyalty point structure or redemption options, at any time. If the App or any part of the loyalty program is discontinued, the Company is not obligated to convert loyalty points or provide any form of compensation.


9. Disclaimer of Warranties

The App is provided "as is" without any warranty, whether express, implied, or statutory. The Company disclaims all warranties, including those of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Access and use of the App are at your own risk.


10. Limitation of Liability

To the fullest extent permitted by law, the Company shall not be liable for any damages, including loss of data, business interruption, or financial loss, arising from your use or inability to use the App. In no event shall the Company’s total liability exceed the amount you paid, if any, to use the App.


11. Governing Law and Dispute Resolution


This EULA is governed by the laws of the State of New Mexico, without regard to its conflict of law principles. Any disputes arising from this EULA or your use of the App will be subject to binding arbitration or resolved in the courts of New Mexico.
